These Terms and Conditions govern your access to and use of the Ether mobile application, website, services, features, and related software, collectively referred to as the Service.

The Service is operated by Reloom Studios (OPC) Private Limited, referred to as the Company, we, us, or our. By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 16 years old to use the Service.

By creating an account, accessing, or using the Service, you confirm that you are at least 16 years old and legally permitted to use the Service in your jurisdiction.

If you are 16 or older but under the age of majority in your jurisdiction, you may use the Service only with permission from a parent or legal guardian. Parents or legal guardians are responsible for supervising a minor's use of the Service, including location sharing, circles, journey tracking, emergency contacts, and safety alerts.

The Service is not intended for anyone under 16. If we learn that we have collected personal information from a person under 16, we will take appropriate steps to delete that information.

2. About the Service

Ether provides features that may include:

The Service is designed to support convenience, safety awareness, and coordination. It is not a substitute for emergency services, professional navigation systems, medical care, roadside assistance, law enforcement, or personal judgment.

3. Account Registration

To use certain features, you may need to create an account using your phone number, email address, Google account, Apple account, Firebase authentication, or another supported sign in method.

You agree to provide accurate information and keep it updated. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

You must notify us immediately if you suspect unauthorized access to your account.

4. Location Sharing and Consent

The Service relies on location permissions to provide core features. You control whether location sharing is enabled through your device settings and in app controls.

By enabling location based features, you understand that your location may be collected, processed, and shared with people or groups you select, such as family circles, ride groups, emergency contacts, or other authorized users.

You are responsible for ensuring that any person you invite to a circle, group, ride, or shared journey understands how their location may be used.

5. Emergency and Crash Features

The Service may include crash detection, emergency countdowns, alerts, or emergency contact notifications. These features depend on device sensors, permissions, network connectivity, battery status, GPS accuracy, and other conditions outside our control.

We do not guarantee that crash detection, emergency alerts, route warnings, notifications, or location sharing will always be accurate, timely, available, or delivered.

You should always contact local emergency services directly in an emergency.

6. User Responsibilities

You are responsible for complying with all applicable laws, including laws related to privacy, consent, tracking, driving, emergency communications, and data protection.

7. User Content

You may submit or generate content through the Service, including profile details, contacts, journey data, location data, route data, photos, messages, alerts, and other information.

You retain ownership of your content. You grant us a limited license to host, store, process, transmit, display, and use your content only as needed to operate, improve, secure, and provide the Service.

You represent that you have the necessary rights and permissions to submit any content you provide.

8. Subscriptions and Payments

Some features, including the Host Subscription (available as a Weekly or Monthly plan), require a paid, auto-renewing subscription purchased through the Apple App Store or Google Play. The title, length, and price of each plan are displayed in the app before you purchase.

Payment will be charged to your Apple ID or Google Play account at confirmation of purchase.

Subscriptions automatically renew for the same length and price unless auto-renew is turned off at least 24 hours before the end of the current period.

Your account will be charged for renewal within 24 hours prior to the end of the current period, at the then-current price for the plan.

You can manage your subscription and turn off auto-renewal at any time in your Apple ID or Google Play account settings, after purchase. Turning off auto-renewal does not cancel the current, already-paid period.

No cancellation of the current subscription is allowed during the active subscription period, but you may choose not to renew.

Payments, renewals, cancellations, refunds, and billing disputes are otherwise governed by the applicable Apple App Store or Google Play terms.

We may change subscription pricing or features with notice where required by law; changes apply to future billing periods, not a period already paid for.

9. Third Party Services

The Service may use or integrate with third party services such as maps, cloud hosting, authentication providers, payment processors, push notification providers, SMS or OTP providers, analytics tools, and communication services.

We are not responsible for third party services, their content, availability, or privacy practices. Your use of third party services may be subject to their own terms and policies.

10. Availability and Changes

We may modify, suspend, or discontinue any part of the Service at any time. We may also update features, fix bugs, improve security, or change how certain functionality works.

We do not guarantee uninterrupted or error free operation of the Service.

11. Safety Disclaimer

Route intelligence, warnings, estimated locations, travel history, crash detection, and emergency alerts are provided for informational purposes only.

You should independently verify road conditions, safety risks, navigation instructions, emergency situations, and legal requirements. Do not rely solely on the Service for safety critical decisions.

12. Intellectual Property

The Service, including software, branding, designs, logos, text, graphics, interfaces, and other materials, is owned by us or our licensors and is protected by intellectual property laws.

You may not copy, modify, distribute, sell, lease, or create derivative works from the Service except as permitted by these Terms or applicable law.

13. Termination

We may suspend or terminate your access to the Service if you violate these Terms, misuse the Service, create risk for other users, or if required by law.

You may stop using the Service at any time. You may request account deletion using in app account deletion tools (Profile > Settings > Delete account), or without the app installed as described on our Account and Data Deletion page.

14. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of data, profits, goodwill, personal injury, missed emergency alerts, location inaccuracies, or service interruptions.

Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the 12 months before the claim, or INR 10,000, whichever is greater, unless applicable law requires otherwise.

15. Indemnity

You agree to indemnify and hold harmless Reloom Studios (OPC) Private Limited, its directors, employees, contractors, affiliates, and partners from claims, damages, liabilities, costs, and expenses arising from your misuse of the Service, violation of these Terms, violation of law, or infringement of another person's rights.

16. Governing Law

These Terms are governed by the laws of India, without regard to conflict of law principles.

Any disputes will be resolved in the courts located in India, unless applicable consumer protection law gives you the right to bring claims elsewhere.
